00 / INFRASTRUCTURE OVERVIEW This digital infrastructure is operated by INDIVIDUAL. Throughout this site, the terms “we”, “us” and “our” refer to INDIVIDUAL. We provide this digital space, including all information, tools, and operational systems available to you, conditioned upon your strict acceptance of all terms, conditions, policies, and notices stated here.

By accessing our site and/or securing a physical allocation (purchasing a product), you engage in our “System” and agree to be bound by the following operational terms (“Terms of Operation”, “Terms”), including those additional policies referenced herein. These Terms apply to all users of the digital architecture.

Please review this document carefully. By accessing or using any part of this site, you agree to be bound by these Terms of Operation. If you do not agree to all conditions, you are prohibited from accessing the website or utilizing our System.

01 / SYSTEM ACCESS PROTOCOL By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our garments or System for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to intellectual property and copyright laws). You must not transmit any disruptive code, worms, or viruses into our infrastructure. A breach of these protocols will result in immediate termination of your access.

02 / OPERATIONAL CONDITIONS We reserve the right to refuse access to our System to anyone, for any reason, at any time. You understand that your content (excluding payment data) may be transferred unencrypted across various networks to conform to technical requirements. Payment data is permanently encrypted during all network transfers. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of our garments, System, or brand architecture without our express written authorization.

03 / DATA ACCURACY & MODIFICATION We are not responsible if information made available on this site is not entirely accurate, complete, or current. The material provided is for general reference and should not be relied upon as the sole basis for decision-making. We reserve the right to modify the contents of this site at any time without obligation to issue external updates.

04 / SYSTEM ADJUSTMENTS & PRICING Pricing for our garments is subject to change without notice. We reserve the right to modify, suspend, or discontinue the System (or any part of the collection) at any time. We shall not be liable to you or any third party for any modification, price adjustment, or discontinuation.

05 / PHYSICAL ALLOCATIONS (PRODUCTS) Certain garments may be available exclusively online through this infrastructure. These pieces are engineered in limited quantities and are subject to strict return or exchange protocols as outlined in our Returns Protocol. We have made every effort to display the structural colors and physical textures of our garments accurately; however, we cannot guarantee your monitor's display will reflect the true physical standard.

We reserve the right to limit the sales or quantities of our garments to any person, geographic region, or jurisdiction at our sole discretion. All product descriptions and pricing are subject to immediate change. We do not warrant that the physical quality of any purchased item will meet subjective expectations, though they are built to our uncompromising internal standards.

06 / BILLING ARCHITECTURE & ACCOUNT INTEGRITY We reserve the right to refuse or limit any order placed within our System. We may restrict quantities secured per person, per household, or per order. In the event of an order cancellation or modification, we will attempt to notify you via the email and/or billing address provided. We strictly prohibit orders that appear to be placed by unauthorized resellers or distributors.

You agree to provide current, complete, and accurate acquisition and account information for all transactions. You must promptly update your account metrics, including email and payment details, to ensure flawless logistical execution.

07 / EXTERNAL INTEGRATIONS We may provide access to third-party tools over which we have no direct control. You acknowledge that we provide access to these tools ”as is” without any warranties or endorsements. We carry no liability arising from your use of optional third-party integrations.

08 / THIRD-PARTY ROUTING Certain content and features may route you to third-party websites not affiliated with INDIVIDUAL. We are not responsible for evaluating their content and will not carry liability for third-party materials. Any transactions made on external domains are at your own risk.

09 / USER TRANSMISSIONS & FEEDBACK If you send us creative ideas, proposals, or structural feedback (collectively, 'transmissions'), you agree that we may, without restriction, edit, copy, publish, and utilize those transmissions in any medium. We are under no obligation to maintain transmissions in confidence or offer compensation. You agree your transmissions will not violate any third-party rights or contain malicious, unlawful, or abusive material.

10 / DATA ARCHITECTURE Your submission of personal data through this System is strictly governed by our Data Architecture & Privacy Protocol.

11 / SYSTEM INACCURACIES Occasionally, information on our site may contain typographical errors or omissions regarding product specifications, pricing, and logistical transit times. We reserve the right to correct any errors and update information or cancel orders if data is inaccurate, without prior notice.

12 / STRICTLY PROHIBITED ACTIONS You are prohibited from using the site or its content: (a) for unlawful purposes; (b) to solicit others into unlawful acts; (c) to violate any regional or international regulations; (d) to infringe upon our intellectual property; (e) to harass, defame, or intimidate; (f) to submit false data; (g) to transmit malicious code; (h) to track the data of others; (i) to spam or scrape the architecture; (j) to interfere with the security features of the System.

13 / LIABILITY LIMITATIONS & WARRANTIES We do not guarantee that your use of our System will be uninterrupted or error-free. The System and all garments delivered are provided 'as is' and 'as available' for your use, without express or implied warranties. In no case shall INDIVIDUAL, our directors, officers, or logistical partners be liable for any injury, loss, or consequential damages of any kind arising from your use of the System or any products acquired through it.

14 / STRUCTURAL INDEMNIFICATION You agree to indemnify and hold harmless INDIVIDUAL and our operational partners from any claim or demand, including reasonable legal fees, made by any third party due to your breach of these Terms of Operation or your violation of any law.

15 / SEVERABILITY If any provision of these Terms is determined to be unlawful or unenforceable, that specific provision shall be severed from these Terms, and the determination shall not affect the validity and enforceability of the remaining architectural provisions.

16 / TERMINATION OF ACCESS These Terms of Operation remain effective unless terminated by either party. You may terminate this agreement by ceasing all use of our System. If we determine you have failed to comply with any provision, we may terminate this agreement without notice, restrict your access, and hold you liable for all pending obligations.

17 / THE COMPLETE PROTOCOL The failure of INDIVIDUAL to enforce any right within these Terms shall not constitute a waiver of that right. These Terms of Operation constitute the entire agreement between you and us, superseding any prior communications or proposals.

18 / JURISDICTIONAL LAW These Terms of Operation and any separate agreements whereby we provide you access to our System shall be governed by and construed in accordance with the laws of the State of Illinois and the United States, operating out of our Aurora headquarters.

19 / PROTOCOL EVOLUTION You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of these Terms of Operation at our sole discretion. Your continued use of the System following any posted updates constitutes total acceptance of those changes.
